Consumer and Energy Supplier Code of Conduct
Energy suppliers want to contribute to consumer trust in the free energy market. That is why Energie-Nederland has drawn up the Consumer and Energy Supplier Code of Conduct. The Consumer and Energy Supplier Code of Conduct contains all relevant rules that energy suppliers and intermediate parties adhere to when selling energy contracts. As such, consumers know what to expect from the selling party and how to hold them accountable if something does go wrong.
Application of the code of conduct
The code of conduct applies to contact between the energy supplier (or a company that operates on behalf of an energy company) and a consumer relating to acquisition, entering into, continuation and termination of supply agreements for energy and related contacts. Energy suppliers who apply the code of conduct indicate that they:
- Will inform consumers correctly,
- Will approach consumers in an appropriate and honest manner as part of customer acquisition,
- Will handle a change of supplier for the consumer in the best possible way.
Important changes
A new code of conduct is effective January 1, 2021. As well as the amendments to the current laws and regulations, the main changes are aimed at further improving the quality of customer acquisition. This way, an energy supplier is able to better safeguard the quality across the chain: from supplier, via distribution platform and intermediary to the individual seller who has the sales talk with the consumer. That is why the changes include the agreements between suppliers and intermediaries for all channels, further tightened agreements for door-to-door sales, and a more detailed complaints procedure. What’s more, these changes fit seamlessly with the objective and method of the Central Intermediary Energy Market Register (CIRE). This register increases transparency in the market of (intermediary) sales of energy contracts.

Please note: Suppliers have been asked to renew their signature on the statement about implementation of the updated code of conduct by January 1, 2021. Therefore, the list of suppliers who have submitted a new accession agreement will continue to be regularly updated in the coming period.
Supplementary statement for supply agreements with dynamic pricing
15 December 2021: The Energie-Nederland Association has reached agreements with the Authority for Consumers and Markets (ACM) on supply agreements with dynamic pricing. These agreements are set out in a supplementary statement with the Consumer and Energy Supplier Code of Conduct and concerns the way in which energy suppliers can inform customers of the advantages and risks of these supply agreements.

Code of Conduct Suppliers Smart Meters 2012
The Code of Conduct for Suppliers of Smart Meters 2012 has been drawn up by Energie-Nederland and lays down the guidelines and principles for the use of measurement data from smart meters. This code of conduct serves as a guideline for energy suppliers to ensure that the use of metering data from smart meters complies with the legal requirements for the processing of this (personal) data. The code of conduct ensures that consumers benefit from the benefits of smart meters without compromising their privacy.

Customized Offering
This document describes the approach ‘Customized Offering,’ which facilitates both consumers (households) and suppliers. The starting point is comprehensible and comparable information. Additionally, ‘chain transparency’ is introduced: the (price) information can be easily traced from the offering, through the agreement, up to billing. Harmonization of terminology and explanations on the energy bill also contribute to comprehensibility and comparability.
Energie-Nederland explicitly makes this explanation and the list of harmonized terms available to other providers in the consumer market as well, such as organizations that facilitate collective purchasing (including auctions), price comparison websites, and resellers.
